However, the decisions in the cases mentioned in (a) to (c) may not be based on special categories of personal data according to Art. 9 Abs. 1 GDPR, unless Art. 9 Abs. 2 lit. a or lit. g applies and appropriate measures have been taken to protect your rights and freedoms and your legitimate interests.
In the cases referred to in (a) and (c), we will take appropriate measures to safeguard your rights and freedoms and legitimate interests, including at least the right to obtain human intervention on the part of the controller, to express your point of view and to challenge the decision.

If the processing is based on your consent acc. Art. 6 Abs. 1 bed. a GDPR or Art. 9 Abs. 2 lit. a GDPR or on a contract in accordance with Art. 6 Abs. 1 bed. b DSGVO is based and takes place using automated processes, you have the right, in accordance with Art. 20 GDPR to receive your personal data that you have provided to us in a structured, common and machine-readable format and to transmit it to another person responsible or to request transmission to another person responsible, insofar as this is technically feasible.
